Mav 12.1998 <br /> <br />Call to Order <br /> <br />8:34 am. <br />A regular meeting of the Colorado Water Conservation Board was <br />reconvened at the Grand Vista Hotel, 2790 Crossroads Blvd., Grand <br />Junction. The meeting was called to order at 8:34 am. on Tuesday, May 12, <br />1998, by Chairperson Patricia Wells. Nine voting members were present at <br />the time of call to order so there was a quorum (at least six required). Board <br />members present were Patricia Wells, David Smith, Eric Kuhn, Ray Werner, <br />Janice Sheftel, Bob Burr, Alan Hamel, Allen Davey, Bill Brown, Jennifer <br />Gimbel (representing the Attorney General), Bruce McCloskey <br />(representing the Division of Wildlife Director) and CWCB Acting Director <br />Peter Evans'. <br /> <br />e <br /> <br />He. Report from Executive Session <br />Tape 2, Start/Stop: 0984 - 1111 <br />Action: Eric Kuhn and Bob Burr recused themselves from item 7a discussion, <br />Mount Emmons Mining Company. Allen Davey made a motion that the <br />Board modify the stipulation to list the other instream flow reaches that are <br />involved with this application, to add a provision requiring that no diversion <br />be made by junior rights if the flow of the river is below the level of the <br />instream flow rights, that a condition be added to section C that requires the <br />applicant to explore other options to inundation in the permitting process, <br />and to inform the Board of those options, and to make clear in section 2e <br />that the Board has reserved the option to deny the request to inundate if it so <br />desires. The motion was seconded by David Smith and approved <br />unanimously (7-0). <br /> <br />12a-b. Instream Flow Program - Informational Items - Summary of Resolved Cases and de <br />minimis Cases <br />Tape 2, Start/Stop: 0000 - 0000 <br />Action: This was an informational item; there was no discussion or formal action <br />taken as a result of these items. <br /> <br />13. <br /> <br />Instream Flow Program - Update on the Instream Flow Subcommittee <br />Tape 2, Start/Stop: 1112 - 1193 <br />Action: This was an informational item; no formal action taken. <br /> <br />e <br /> <br />Minutes May 11.12, 1998 <br /> <br />-- <br />
