,~ e Tuesdav. Mav 12.1998 Call to Order 8:34 am. A regular meeting of the Colorado Water Conservation Board was reconvened at the Grand Vista Hotel, 2790 Crossroads Blvd., Grand Junction. The meeting was called to order at 8:34 am. on Tuesday, May 12, 1998, by Chairperson Patricia Wells. Nine voting members were present at the time of call to order so there was a quorum (at least six required). Board members present were Patricia Wells, David Smith, Eric Kuhn, Ray Werner, Janice Sheftel, Bob Burr, Alan Hamel, Allen Davey, Bill Brown, Jennifer Gimbel (representing the Attorney General), Bruce McCloskey (representing the Division of Wildlife Director) and CWCB Acting Director Peter Evans'. e He. Report from Executive Session Tape 2, Start/Stop: 0984 - 1111 Action: Eric Kuhn and Bob Burr recused themselves from item 7a discussion, Mount Emmons Mining Company. Allen Davey made a motion that the Board modify the stipulation to list the other instream flow reaches that are involved with this application, to add a provision requiring that no diversion be made by junior rights if the flow of the river is below the level of the instream flow rights, that a condition be added to section C that requires the applicant to explore other options to inundation in the permitting process, and to inform the Board of those options, and to make clear in section 2e that the Board has reserved the option to deny the request to inundate if it so desires. The motion was seconded by David Smith and approved unanimously (7-0). 12a-b.
