Gentlemen:

We want to thank you for Dan Merriman attending our meeting on February 13. 1999 and explaining the Colorado
Water Conservation Board's IDStrearn Flow Program to us. He was very helpful and answered many questions and gave
us some clarification on what is happening regarding Case #2.98CWI74 (City of Cripple Creek applying for diversion
of water from Fourmile Creek), There were 86 concerned people from the 4.Mi]e (Teller County) community at the
meeting. We strongly support your filing ofa Statement of Opposition regarding this case, We have also filed an
opposition in this matter.

Since the meeting, Lakemoor West Property Owners Association has learned that water rights from Founnile Creek,
dated ]874 and ]886, were adjudicated to the LWPOA for well use for each of the 73 property owners, The case
number is C1RW-4099, We have also been informed that Fourmile Creek was tested and certified to be one of the
purest creeks in the State of Colorado, We want to keep it that way and not have the City of Cripple Creek put treated
sewage water into Fourmile Creek. They have a reputation of releasing water tl1at exceeds the State limits for purity.

We do not fully understand the Pisgah Reservoir and Ditch Company's letter of opposition to what you want to do
regarding minimum flow on Founni]e creek, but we are attempting to get clarification from them, Aoything tl1at you
could tell us about tl1at letter from them, dated November 12, ] 998, would be appreciated.

The community living along Fourmile Creek in southwestern Teller County strongly supports the maintenance of a flow
level in the creek commensurate with the maintenance of the average levels of native flora and fauna in and along the
creek as they are found today. To us who live along the banks, the Fourmile Creek is an integriII part of our community,
It supplied water to replenish our household and domestic wells, It provides water in times of emergency to extinguish
structure and wild fires. It provides a home for the animals, such as trout, deer. elk, coyote, bear and mountain lion, tl1at
give our community its rural charm. It is an essential scenic element central to the visual beauty of our community, It
waters our livestock,

We are representing 73 property owners in Lakemoor West Ranch and many ranchers and concerned citizens in the
southwest Teller County area, We are presently interviewing attorneys to represent aI] concerned.
