<br />Agenda Item 6g <br />Case No. 2-98CW174; City of Cripple Creek <br /> <br />Apolication SummllIY <br /> <br />This is an application for three conditional surface water rights on Fourmile Creek (Fourmile <br />Creek Pipeline, Cripple Creek Evergreen Station Pipeline and Oil Creek II Pipeline) near Cripple <br />Creek in Teller and Fremont Counties (see attached map). Applicant seeks to augment the out-of- <br />priority depletions from Oil Creek and Fourmile Creek from the 3 points mentioned above by: <br />(1) directly bypassing consumptive use credits associated with the historically irrigated lands; <br />(2) releasing stored consumptive use credits associated with the historically irrigated lands from <br />either West Fourmile Creek Reservoir or Oil Creek Reservoir; <br />t3) using~Beaverereek transbasinwater credits; <br />(4) releasing stored transbasin credits from Founni1e Creek Reservoir or Oil Creek Reservoir. <br />Applicant is also requesting the right to exchange Beaver Creek transbasin credits upstream to all <br />3 diversion points and to Fourmile Creek Reservoir and Oil Creek Reservoir with a December 7, <br />1998, exchange date. <br /> <br />CWCB Appropriations <br /> <br />The Board holds an instream flow appropriation in case no. 2-95CW233 on Founni1e Creek in the <br />amount of 3.5 cfs, summer, and 1.5 cfs, winter, with an appropriation date of November 6, 1995, <br />which could be injured by this application. <br /> <br />Potential for Inimy <br /> <br />Applicant's proposed plan for augmentation including exchange may not replace depletions to the <br />Board's Fourmi1e Creek instream flow segment in the same time, amount, and location at which they <br />occur. The Board's Fourmile Creek instream flow could be injured if the Applicant does not fully <br />augment diversions from the Oil Creek Pipeline and the Oil Creek Pipeline II which are located <br />upstream of the Board's instream flow water right. <br /> <br />Other Objectors <br /> <br />Other objectors include the Cripple Creek and Victor Gold Mining Company, Canon Heights Irrigation <br />and Reservoir Company, Four Mile Planning Committee, Pisgah Reservoir and Ditch Company, City <br />of Colorado Springs, US Bureau of Land Management, Southeastern Colorado Water Conservancy <br />District, Rainbow Valley Water District, Teller County, State Board of Land Commissioners, Colorado <br />State Engineer, Bud L. and Betty M Chess and Roy and Beneta Canterbury. <br /> <br />298CWI74_mern <br />
