appropriate storage location on Morrison Creek. If the CWCB were to commence the process
to appropriate a new instream flow on Morrison Creek, it would force the Upper Yampa
District to select a reservoir site for the changed location of the Pleasant Valley right,
prematurely and without the exhaustive engineering, hydrologic, and political process that is
most appropriate.

Additionally, we recently negotiated and executed a new lease agreement with the
Colorado Division of Parks for the recreational area north of Stagecoach Reservoir. In that
recreational lease, the Division of Parks acknowledges the expectation and efforts of the Upper
Yampa District to expand Stagecoach Reservoir, and agrees not to oppose such expansion in
any way, Since the enlargement of Stagecoach Reservoir may well inundate a short stretch of
the Yampa River above the current inlet into Stagecoach Reservoir, the Board of Directors of
the Upper Yampa District considers it inappropriate for the Division of Parks to be requesting
a new instream flow appropriation at the inlet to Stagecoach Reservoir which could be a basis
for opposition for, or compromise of, the proposed enlargement ofthe Reservoir,

For all of the above reasons, the Upper Yampa Water Conservancy District strongly
urges that the CWCB not consider any new instream flow water right appropriation on the
above two streams now or in the near future,
