<br />e <br /> <br />e <br /> <br />e <br /> <br />Consent Agenda Item lr <br />Case No. 5-02CW373; Grand Elk Partners <br /> <br />Application Sununary <br /> <br />This is an application for a change of water rights and an application for an augmentation plan near <br />the Town of Granby.. (please see the attached map). The Applicant seeks to divert its water rights <br />at an adjacent point of diversion and to irrigate different lands than have been historically irrigated. <br />In addition, the Applicants seeks to augment its depletions with releases from the Green Mountain <br />Reservoir which is located downstream of where the depletions impact Tenmile Creek and the <br />Fraser River. <br /> <br />CWCB Appropriations <br /> <br />The Board holds the following instream flow water rights that could be injured by this <br />application: <br /> <br />Case No. <br />5-90CW308B <br />5-90CW294 <br /> <br />Stream!Lake <br />Praser River <br />Tenmile Creek <br /> <br />Amount (cfs/af) <br />30/19 <br />4/2 <br /> <br />Appropriation Date <br />11/27/1990 <br />11/27/1990 <br /> <br />Potential for Iniury <br /> <br />The Applicant's proposed change of water rights may injure the CWCB's instream flow water <br />rights by diverting at the upstream point of diversion when the CWCB's intervening instream flow <br />water rights are not being satisfied. In addition, an expansion of this water right could injure the <br />CWCB's instream flow water rights. Also, the Applicant's proposed augmentation plan may not <br />adequately replace depletions in time, place, and amount. <br /> <br />Other Objectors <br /> <br />The other objectors in this case include: Rendezvous Colorado, LLC; Alice and Gary Nordloh; <br />James, Cathleen, and Donald Hackstaff; the Solvista Corporation; and the Winter Park Water and <br />Sanitation District. <br /> <br />L:lSection FolderslSECC\Case Files\2002\502CW373memo.doc <br />
