<br />. <br /> <br />who are now operating under an annual Substitute Water Supply Plan. A major source <br />of augmentation release in the Case is Ruedi Reservoir, located on the Fryingpan River. <br />Releases from the Reservoir enter the Roaring Fork River at its confluence with the <br />Fryingpan. Of the 120 water users, 20 are located within the "upper" Roaring Fork River <br />above its confluence with the Fryingpan River. These users will be augmented by <br />exchange as the Reservoir releases do not directly enter this reach of river. <br /> <br />The application referred to as the "Batch Plan" is a requirement of the BWCO's approved <br />Operating Plan. Under the operation of the plan, the State Engineer requires the BWCO <br />periodically move its contractees from the Substitute Water Supply Plan to a decreed <br />plan for augmentation and exchange. Case No. 01 CW305 is one in a series of plans for <br />augmentation that have been decreed as required. <br /> <br />1.2 Case No. 02CW77 <br /> <br />Case No. 02CW77 outlines a plan for augmentation and exchange for water uses that . <br />will join the BWCO's Operating Plan on or after January 1, 2005. The application, <br />referred to as the "Umbrella Plan," seeks to establish specific exchange reaches and <br />limited exchange amounts at locations throughout the BWCO service area including the <br />Roaring Fork River above its confluence with the Fryingpan River. Within the "upper" <br />Roaring Fork reach, the BWCO requests an exchange of up to 2.25 cfs of depletion with <br />a priority date of July 2, 2001. <br /> <br />1.3 CWCB Water Right <br /> <br />Ouring the 1970s and 1980s, the CWCB established minimum instream flows for <br />numerous reaches on the Roaring Fork River. In 1985 (Case No. 85CW646), an <br />instream flow decree for the portion of the Roaring Fork River between Maroon Creek <br />and the Fryingpan River was established. The instream flow was decreed for 55 cfs <br />between April 1 and September 30, and 30 cfs between October 1 and March 31. <br /> <br />. <br /> <br />4 <br />
