Based on discussions with all of the contestors, the site visits to the Mt. <br />Emmons Iron Fen on June 25, and to the Spring Creek Spring on June 26, the complexity, factual <br />and regulatory issues and the resource protection issues relating to the Mt. Emmons Iron Fen and <br />Spring Creek, CWCB Staff and all PartieslParticipants agreed that it would be best if the Board <br />would table any action on these cases until more studies could be designed and the data could be <br />collected and analyzed. Staff received letters (see attached) from all PartieslParticipants requesting <br />an extension of time regarding the proceedings in these two cases prior to the deadline for submitting <br />Prehearing Statements. Based on these letters and discussions with the PartieslParticipants and for <br />the good cause shown regarding the need for additional data, staff requested the Hearing Officer <br />postpone the Prehearing Conference and the deadline for submitting the Prehearing Statements <br />pending the Board's consideration of the request to table these matters (see attached Staff Motion). <br />Based on this request and the Hearing Officer's ability to assist the Parties with procedural matters <br />and manage this proceeding, Dan McAuliffe, the acting Hearing Officer, issued an order (see <br />attached order) to delay the Prehearing Conference and related deadlines pending the Board's <br />consideration of the request to table these matters. All PartieslParticipants have received and <br />concurred with the order to delay the Prehearing Conference. <br /> <br />STAFF RECOMMENDATION <br />Staffrecommends the Board vacate the hearings set for September 10-12, 2002 on the Mt. Emmons <br />Iron Fen lake level and the Spring Creek instream flow appropriations and to table Board action on <br />these appropriations until 2003, to allow additional time for studies and data collection. In addition, <br />staff is also requesting that the Board preserve January 23, 2002, the date it publicly formed its intent <br />to appropriate as the earliest appropriation date it may claim. <br /> <br />Attachments <br /> <br />Flood Protection.
