Dear Board Members:

The Forest Service is a party to the CWCB's appropriation of a Natural Lake Level Water Right
on Mt. Emmons Iron Fen in Water Division 4. We would like to request an extension of time
delaying the CWCB's final action in appropriating this water right and would support a CWCB.
staff recommendation for an extension of time for the reasons outlined below.

Since our notice to contest has been filed, we have been engaged in discussions with the State
and other objectors concerning the protection of this resource. Based on these discussions, we
believe that the best way to proceed in this matter is to collect additional data. Weare
coordinating a study plan for the collection of these data with the State and other objectors. ,

We believe that an extension of these proceedings will allow us to better assess the resource
protection issues at the Mt. Emmons IronFen. We also hope that an extension will allow us to
engage in negotiations to infonnally resolve our concerns.
