Creates an 8-member board of <br />directors of the district consisting of one representative from each of the <br />Douglas and Arapahoe county boards of county commissioners, one <br />representative chosen jointly by the Douglas and Arapahoe county <br />commissioners, one representative appointed by each of the 4 largest <br />water providers within the district, and one representative elected by the <br />other water providers. Specifies inclusion and election requirements and <br />the district's taxing and water project financing, construction, and <br />operation authorities. <br />Authorizes the district to seek ways to use renewable water <br />conjunctively with Denver basin aquifers and to provide water supplies <br />to water providers within the district. Requires the district's water <br />decrees for water rights that would transport water across a water di vision <br />boundary to include terms and conditions, on a case-by-case basis, to <br />ensure that present decreed beneficial uses of water will not be <br />substantially impaired or substantially increased in cost. <br /> <br />Be it enacted by the General Assembly of the State of Colorado: <br />SECTION 1. Title 37, Colorado Revised Statutes, is amended <br />BY THE ADDITION OF A NEW ARTICLE to read: <br />ARTICLE 49 <br /> <br />Douglas-Arapahoe Water Conservation District <br />37-49-101. Legislative declaration. (1) THE GENERAL <br />ASSEMBLY FINDS, DETERMINES, AND DECLARES THAT IN RECOGNmON OF <br />THE "COLORADO 64 WATER PRINCIPLES" ENDORSED BY THE COLORADO <br /> <br />GENERAL ASSEMBLY IN HOUSE JOINT RESOLUTION 03-1019 AND THE <br /> <br />COMBINED EFFECTS OF RECENT POPULATION GROWTH, SEVERE DROUGHT, <br />INCREASED RELIANCE ON GROUND WATER SUPPLffiS IN THE DENVER BASIN <br /> <br />AQUIFERS, COUPLED WITH PROJECTED GROWTH AND INCREASING NEEDS <br />FOR WATER CONSERVATION AND RELIABLE, RENEWABLE, AND <br />SUSTAINABLE WATER SUPPLffiS, IT IS OF VITAL IMPORTANCE TO PROMOTE <br /> <br />-2- <br /> <br />HB05-1298 <br />
