Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. 39-22-1001 (5) (c) (I), Colorado Revised Statutes,

is amended to read:

39-22-1001. Limitation on the duration of voluntary

5 contribution programs. (5) For income tax years commencing on or
6 after January I, 2003, every voluntary contribution established in this
7 article shall receive a minimum dollar amount of contributions in each

8 income tax year as follows:

9 (c) (I) Paragraphs (a) and (b) of this subsection (5) shall not apply

10 to the western slope military veterans' cemetery voluntary contribution

established in part 19 of this article AND THE COLORADO WATERSHED
PROTECTION FUND VOLUNTARY CONTRIBUTION ESTABLISHED IN PART 24

13 OF THIS ARTICLE. Such voluntary contribution PROGRAMS shall not be

14 required to receive a minimum amount of contributions in any income tax

15 year.
16 SECTION 2. 39-22-2402, Colorado Revised Statutes, is amended
17 to read:

18 39-22-2402. Voluntary contribution designation - procedure.
19 For income tax years commencing on or after Ja:llud.y 1,2002 JANUARY
20 1,2005, but prior to Janna1} 1,2005 JANUARY I, 2008, the Colorado state
21 individual income tax return form shall contain a line whereby each
22 individual taxpayer may designate the amount of the contribution, if any,
23 the individual wishes to make to the Colorado watershed protection fund

created in section 39-22-2403.

SECTION 3. Effective date. This act shall take effect at 12:01
