<br />. <br /> <br />. <br /> <br />. <br /> <br />8116/99 USBR Staff Draft <br /> <br />A BILL <br />TO AUTHORIZE THE SECRETARY OF THE INTERIOR TO ENTER INTO <br />CONTRACTS FOR THE USE OF EXCESS CAPACITY IN BUREAU OF <br />RECLAMATION FACILITIES, AND FOR OTHER PURPOSES <br /> <br />Be it enacted by the Senate and House of Representatives of the United States of America in <br />Congress assembled That: <br /> <br />Section 1. Short Title. <br /> <br />This Act may be cited as the "Reclamation Projects Excess Facilities Capacity Act." <br /> <br />Section 2. Definitions. <br /> <br />As used in this Act: <br /> <br />(1) The term "project contractor" shall mean any person or entity which has a contract <br />with the United States, acting through the Secretary of the Interior, that provides for the use of <br />project water by such person or entity. <br /> <br />(2) The term "ineligible land" shall mean any land which is not entitled, or otherwise <br />eligible, to receive project water: (i) by virtue of the requirements and conditions set forth in the <br />Act of June 17, 1902 (32 Stat. 388), and acts amendatory thereof and supplementary thereto, in <br />the Act of August I I, 1939 (16 U.S.c. gg590y - 590z-10), in any regulations or agency guidance <br />implementing those acts, or in any contract between the Secretary and a project contractor, or (ii) <br />by virtue of any determination made by the Secretary pursuant to such acts, regulations, or <br />contracts. <br /> <br />. <br /> <br />(3) The term "non-project water" shall mean: (i) water diverted and/or stored based upon <br />the exercise of water rights which have not been appropriated or acquired by the United States or <br />others, or which have not been decreed, permitted, certificated, licensed, or otherwise granted to <br />the United States or others, for Reclamation project facilities, and (ii) water not reserved or <br />allocated by the United States to Reclamation project facilities. <br /> <br />(4) The term "project water" shall mean: (i) water diverted and/or stored based upon the <br />exercise of water rights which have been appropriated or acquired by the United States or others, <br />or which have been decreed, permitted, certificated, licensed, or otherwise granted to the United <br />States or others, for Reclamation project facilities, and (ii) water reserved or allocated by the <br />United States to Reclamation project facilities. <br />
