<br />- .. -.,0 <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />ATTACHMENT 3 <br /> <br />RESOLUTION OF THE COLORADO WATER CONSERVATION BO <br />REGARDING DELIVERY OF WATER FROM WOLFORD MOUNTAIN RE <br /> <br />November 21,1994 <br /> <br />. --........~ <br /> <br /> <br />CONCERNING THE DELIVERY OF WATER TO THE 15 MILE REACH OF <br />COLORADO RIVER TO PROTECT THE ENDANGERED FISHES OF THE UPPER <br />COLORADO RIVER BASIN. <br /> <br />WHEREAS the Colorado Water Conservation Board (Board) hereby determines that the loan of <br />Wolford Mountain Reservoir water from the Colorado River Water Conservation District <br />(District) to the Board for delivery to and through the 15 Mile Reach of the Colorado River in <br />accordance with the attached Memorandum of Agreement (MOA) is an element of the Recovery <br />Implementation Program Recovery Action Plan (RIPRAP) required to preserve the natural <br />environment to a reasonable degree for the benefit of the listed species in the Upper Colorado <br />River basin. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE Colorado Water Conservation Board that: <br /> <br />(I) The loan of water pursuant to the MOA is required for minimum stream <br />flows to preserve the natural environment to a reasonable degree. This <br />, 3,000 af along with other water and/or water rights is presently needed to <br />preserve the natural environment to a reasonable degree, as the Board has <br />or may in the future determine. <br />(2) The purpose of the loan is to benefit the listed species in the Upper <br />Colorado Riverbasin. <br />(3) Paragraph 3 of the MemorandUlll of Agreement entered into on September <br />21, 1993, between the Board and the U.S. Fish and Wildlife Service (the <br />. Enforcement Agreement), a copy of which is attached as Exhibit!, will <br />apply to the loan. <br />(4) The Board has the authority to enter into the MOA. . <br />(5) . The Board hereby authorizes the Director to execute the MOA. <br /> <br />.
