DNR <br />O;uiesC.lile, P.E. <br />Director. eWeB <br /> <br />TO: <br />FROM: <br /> <br />Colorado Water Conservation Board Members <br />Randy Seaholm i2!J.\- <br />Sue Uppendahl S~ <br />March 3, 1998 <br />Agenda ltem 18,c.iii, March 10-11, 1998, Board Meeting __ <br />Memorandum of Agreement Regarding Wolford Mountain Reservoir <br />Releases for Endangered Fish Species - Approval <br /> <br />DATE: <br />SUBJECT: <br /> <br />INTRODUCTION <br /> <br />The Colorado River Water Conservation District (River District) is reconsulting <br />under Section 7 of ESA on the Wolford Mountain Reservoir Project in order to bring <br />their COE and BLM project approvals in line with the current planning for West Slope <br />marketing of Wolford water and Denver Water's post-lease permanent use of water for <br />municipal substitutions, Furthermore, the River District needs to recognize the 6,000 AF <br />storage enlargement which resulted from a reduced PMP / PMF calculation, A new <br />Biological Opinion is expected to be issued soon along with a revised Memorandum of <br />Understanding (MOU) with the U,S, Fish & Wildlife Service (Service) (Attachment I), <br /> <br />As mitigation for the Wolford Mountain depletion impacts to the endangered fishes in <br />the Upper Colorado River, a revised MOU has been agreed to between the River District <br />and the Service. This MOU provides for storGlge in and releases from Wolford to and <br />through the l5 Mile Reach of the Colorado River, When the MOU between the Service <br />and the River District is revised, the Memorandum of Agreement (MOA) with the Board <br />and the River District protecting their leases to the 15 Mile Reach will also need to be <br />updated, The River District anticipates this revised MOA will be the final condition <br />needed in order for the new MOU with the Service to become effective and allow the <br />River District to proceed with their West Slope water marketing, <br /> <br />The Service hGls determined that progress under the Recovery Program must be sufficient <br />to offset impacts of a project before it will issue a favorable Biological Opinion, In <br />Wolford's case, progress was not sufficient. The Service identified actions in the <br />Recovery Implementation Program Recovery Action Plan to serve as the reasonable and <br />prudent alternative, The additional conservation measure was included in the Wolford <br />Biological Opinion and was implemented through a Memorandum of Understanding <br />between the Parties executed on February 7, 1990, <br /> <br />Subsequent to the execution of the original MOU, the following events or changes have <br />occurred: <br />
