.- .

.

.

.

CARLSON, HAMMONn & PAnnOCK, L.L.C.

Colorado Water Conservation Board
March 9, 1998
Page 2

included in the CWCB's February 5, 1998, Notice of Intent to Appropriate Instream Flow
Water Rights. The portion of each instream flow segment that would be inundated is
located on private land owned by Pueblo. The dam for Pueblo's proposed reservoir will be
located in the northwest quarter of Section 9, Township 9 South, Range 80 West of the 6th
P.M.

In addition to native water available for storage in priority, the reservoir will provide
direct storage capacity for two of Pueblo's transmountain diversion ditches (including the
Ewing Ditch - one of the oldest transmountain diversion in the State). Also, Pueblo wi II be
able to store its other transmountain and reusable waters in the reservoir by exchange.
Thus, the reservoir is an important and valuable component of Pueblo's long-term municipal
supply plans.

We are still in the process of compiling the material necessary to prepare a full report
to the CWCB at its next meeting scheduled for May 11 and 12, 1998. However, we wanted
to provide this summary of Pueblo's plans to the Board members as soon as possible. We
hope that the CWCB will allow us to present a more detailed report at that meeting.

At the May meeting Pueblo plans to formally request that the CWCB consider
delaying its appropriation of the proposed instream flow reach on Tennessee Creek until
Pueblo is able to secure a water storage decree for the reservoir. In the alternative, it may
be worthwhile to explore a possible stipulation by which the CWCB would recognize the
senior priority of Pueblo's storage appropriation. Pueblo also anticipates submitting a formal
"Request to Inundate" the stretch of East Tennessee Creek pursuant to Rule 8.10 of the
CWCB's Rules and Regulations when appropriate.

Thank you for taking this information into consideration and we look forward to
presenting a more detailed report to the CWCB at its May 1998 meeting. In the interim,
please feel free to contact me or Bill Paddock of this office, or Bud O'Hara at Pueblo's
Board of Water Works for more information at (719) 584-0236.

Yours very truly,

~~;~~

cc: Bud O'Hara
Bill Mattoon, Esq.

PCFW-711
