<br />By detlnJt.ion, then. the Arn1y Corps
<br />ot Engineers would lose jurisdlction aver
<br />wetlands. since wet.la.nds are not navi-
<br />gable. This change alone should elimi-
<br />nate most ot the problems that have
<br />been caused by =ent corps policy and
<br />regulations. However, I. too. share con-
<br />cern that ll<lI1Imv1gable .....ters--orten
<br />reterred to lIS "wetlands"-bave some
<br />degree ot protection. A major provisJon
<br />ot my hill allows the Governor ot any
<br />State. with the concurrence of that
<br />State's legislature, to provide the Secre-
<br />tary ot the Army with a written request
<br />to extend application ot thJs act to those
<br />waters, other than navigable waters.
<br />Mr. Presldent. I strongJy endorse the
<br />right ot a State to make thJ:; detennina-
<br />tion to seek Federal assistance if it so
<br />chooses. Wetlands adjacent to navigable
<br />waters can then be evaluated and pro-
<br />tected on a local basis.
<br />Again, I em pleased that Senator
