<br />1 <br /> <br />thirteen members. The executive director of the department of <br />natural resources, attorney general, state engineer, and director <br /> <br />2 <br />3 <br /> <br />of said board shall be NONVOTING members ex-officio. The nine <br /> <br />4 remaining members shall be qualified electors of the state, well <br />5 versed in ~ater matters, and shall be appointed by the governor <br />6 for terms of three years. The appointments sha 11 be made in such <br /> <br />7 a manner that the terms of three members shall expire on May 12 <br /> <br /> <br />8 "of each year. The members of said board who were appointed and <br /> <br />9 are now serving as such members shall continue to serve" as such <br /> <br />10 members. In case a vacancy occurs in the appointed membership of <br /> <br /> <br />11 the board by death, resignation, or otherwise, the governor shall <br /> <br />12 appoint a successor to serve the unexpired term of any member of <br /> <br />13 the board. <br /> <br />14 <br /> <br />SECTION 2. 37-60-119 (2), Colorado Revised Statutes 1973, <br /> <br />15 as amended, is amended to read: <br /> <br />16 <br />17 <br /> <br />37-60-119. Construction of water and power facilities - <br /> <br />contracts with and charqes aqainst users. <br /> <br />(2) The board may <br /> <br />18 enter into contracts for the use of said flood control, water, <br /> <br />19 power, and any related recreational facilities by and with any <br />20 agency or political subdivision of this state or the federal <br />2l government, with individuals, with corporations, or with <br />22 organizations composed of citizens of this state. Any such <br />23 contracts may provide for such charges to the using entity as, in <br />24 the opinion of the board, are necessary and reasonable to recover <br />25 the board's capital investment, together with operational, <br /> <br />26 <br /> <br />maintenance, and service charges over the term of years agreed <br /> <br />:2- <br /> <br />\ <br />\ <br />@~~ <br /> <br /> <br />, "- <br />81'., <br />";;' <br />'-~. <br /> <br />(;:;" ", <br />~. ~~,-.. i <br />V <br /> <br />@~ <br />
