thirteen members. The executive director of the department of
natural resources, attorney general, state engineer, and director

of said board shall be NONVOTING members ex-officio. The nine

4 remaining members shall be qualified electors of the state, well
5 versed in ~ater matters, and shall be appointed by the governor
6 for terms of three years. The appointments sha 11 be made in such

7 a manner that the terms of three members shall expire on May 12

8 "of each year. The members of said board who were appointed and

9 are now serving as such members shall continue to serve" as such

10 members. In case a vacancy occurs in the appointed membership of

11 the board by death, resignation, or otherwise, the governor shall

12 appoint a successor to serve the unexpired term of any member of

13 the board.

SECTION 2. 37-60-119 (2), Colorado Revised Statutes 1973,

15 as amended, is amended to read:

37-60-119. Construction of water and power facilities -

contracts with and charqes aqainst users.

(2) The board may

18 enter into contracts for the use of said flood control, water,

19 power, and any related recreational facilities by and with any
20 agency or political subdivision of this state or the federal
2l government, with individuals, with corporations, or with
22 organizations composed of citizens of this state. Any such
23 contracts may provide for such charges to the using entity as, in
24 the opinion of the board, are necessary and reasonable to recover
25 the board's capital investment, together with operational,

26

maintenance, and service charges over the term of years agreed
