<br />123 <br /> <br />e <br /> <br />Consent Agenda Item 21 <br />Case No. 5-00CW284; City of Aspen <br /> <br />Application Swnnuuy <br /> <br />This is an application for water rights for a maximum of 350 cfs for boating (including kayaking, <br />rafting, and canoeing) and general recreational uses on the Roaring Fod<: River, near the Town of <br />Aspen (see attached map). The Applicant has constructed a diversion that channels the Roaring <br />Fod<: River for a distance of 800 feet, and provides "a series of drops in the channel to enhance the <br />recreational experience." <br /> <br />CWCB Aopronriations <br /> <br />The Board holds an instream flow water right for the Roaring Fork River in the amount of32 cfs <br />with an appropriation date of 1/14/76. <br /> <br />Potential for Iniury <br /> <br />No entity, other than the Board shall be granted a decree adjudicating a right to water or interests <br />in water for instream flows in a stream channel between specific points for any purpose <br />whatsoever. This application may violate this statutory requirement. In addition, this application <br />may cause injury to the Board's Roaring Fork River instream flow water rights. <br /> <br />e Other Obiectors <br /> <br />The other objectors in this case are: the State and Division Engineers; Helen Stone; the Twin Lakes <br />Reservoir and Canal Co.; and Trout Unlimited. <br /> <br />e <br /> <br />L:\WCTRANSISECC'lCas.
