PROPOSED FLOW-SHARING AGREEMENT:

1. When the diversion of 10 cfs of flow from the Blue River via the High-Miller Ditch
to the OxbowlFloodplain Fish Habitat Improvements would reduce the flow of the
Blue River below the decreed ISF amount, a flow-sharing agreement shall be
implemented as follows:

a. All diversions to the designated off.channel oxbows that are part of the
OxbowlFloodplain Fish Habitat Improvements shall cease during out-of-
priority periods when river flows are less than or equal to approximately 85%
of the existing [SF for the time period. As such, diversions to the
OxbowlFloodplain Fish Habitat Improvements shall cease when the
following thresholds of flow oceur in the Blue River:

May-September
October - April

105 cfs (ISF: 125 cfs)
74 cfs (ISF 90 & 85 cfs)

During out-of-priority periods and when the following flows are realized in
the Blue River at the Slate Creek Bridge gage (to be installed pursuant to
Section 8 of Appendix V) diversions to the OxbowlFloodplain Fish Habitat
