water rights, as described in section 4.A., above.

Lel!al description of exchanl!e reach: Water available under the subject
Hamilton-Davidson Ditch water rights will be delivered to the confluence
of Slate Creek and the Blue River in the NY. NE\I.i of Section 19,
Township 3 South, Range 78 West of the 6th P.M.; it wiUthen be delivered
down the Blue River to the confluence of the Blue River and Squaw Creek
in the NE\I.i NW\I.i of Section 12, Township 3 South, Range 79 West of the
6th P.M. thence up Squaw Creek and the unnamed tributary of the Mt.
Powell Ranch Pond to the Mt. Powell Ranch Pond described in section
3.A., above or other storage structures described in section 6.B.(2), above.

(4) Exchanlle amount and rate: Up to 30.4 acre-feet per year; 0.3 cfs
(134.7 gpm) maximum exchange rate, CONDITIONAL.

WHEREFORE, Applicant herein requests the Court:

1. To quantify the average annual historical consumptive use of the Subject Water
Rights in acre-feet; and

2. To enter a decree approving the conditional surface water right, the conditional
water storage right, changes of the Subject Water Rights and the plan for
augmentation, including substitution and exchanges described herein and
determining that such conditional surface water right, the conditional water
storage right, changes of water rights and augmentation plan including
substitution and exchanges will not cause injury to any other water rights.
