<br />REDRAFT <br />1-14-04 <br /> <br />Double underlininlit <br />denotes changes from <br />1 and more efficient use of water , including the installation of water meters ,n,,',," <br /> <br />2 or such other measuring and control devices as the board deems <br />3 appropriate in each particular case. <br /> <br />4 (2) The board may, subject to the provisions in section 37-60-122, <br /> <br />5 enter into contracts for the use of, or to loan moneys to enable the <br /> <br />6 construction, rehabilitation, enlargement, or improvement of, said flood <br /> <br />7 control, water, power, and any related recreational facilities, excluding <br /> <br /> <br />8 domestic water treatment and distribution systems, with any agency or <br /> <br />9 political subdivision of this state or the federal government, with <br /> <br />10 individuals, with corporations, or with organizations composed of citizens <br /> <br /> <br />II of this state. Any such contracts may proyide for such charges to the <br /> <br />12 using entity as, in the opinion of the board, are necessary and reasonable <br /> <br />13 to recover the board's capital investment, together with operational, <br /> <br />14 maintenance, and interest charges over the term of years agreed upon by <br /> <br />15 contract. Interest charges shall be recommended by the board at between <br /> <br /> <br />16 zero and seven percent on the basis of the project sponsor's ability to pay <br /> <br />17 and the significance of the project to the development and protection of <br /> <br /> <br />18 the water supplies of the state. Inlerest charges shall be credited to and <br /> <br />19 made a part ofthe Colorado water conservation board construction fund. <br /> <br />20 Any other charges, as determined appropriate by the board, shall be <br /> <br />21 continuously appropriated to the Colorado water conservalion board for <br /> <br />22 supplemental operational AND PERSONAL SERVICES expenditures. <br /> <br />23 SECTION 22. 37-60-122 (I) (c), Colorado Reyised Statutes, is <br /> <br />24 amended to read: <br /> <br />25 37-60-122. General assembly approval. (I) Moneys in the <br /> <br />26 Colorado water conservation board construction fund shall be expended <br /> <br /> <br />27 in the following manner and under the following circumstances: <br /> <br />-19- <br /> <br />DRAFT <br />
