The loans shaH be in the amounls listed in <br /> <br />15 subsection (I) ofthis section, plus or minus such amounts, ifany, as may <br /> <br /> <br />16 be justified by reason of ordinary fluctuations in construction costs as <br /> <br />17 indicated by the engineering cosl indices applicable to the types of <br /> <br />18 construction required for each project or as may be justified by reason of <br /> <br /> <br />19 changes in the plans for a project due to differing or unforeseen site <br /> <br />20 conditions, errors or omissions in the plans and specificalions, changes <br /> <br />21 instituted by regulatory agencies, or changes in material quantities <br />22 beyond contract limits. <br /> <br />23 (3) Pursuant to section 37-60-120 (I), Colorado Revised Statutes, <br /> <br />24 the board shaH require such terms and conditions in the contracts as will <br /> <br />25 ensure repayment of funds made available by it. The board shaH not <br />26 disburse any moneys for any loan au!horized by subsection (I) of this <br /> <br />27 sectiop unless and until the board is satisfied, in its sole discretion, that <br /> <br />-17- <br /> <br />DRAFT <br />
