<br />e <br /> <br />e <br /> <br />e <br /> <br />Consent Agenda Item If <br />Case No. 5-02CW083; United States of America <br /> <br />Application Summary <br /> <br />This is a protest to the revised abandonment list in Water Division No.6 (see attached map). The <br />U.S. (Bureau of Land Management) is protesting the listing of its water rights. These water rights <br />have been leased to the Colorado Water Conservation Board for instream flow purposes in <br />Cathedral Creek. <br /> <br />CWCB Appropriations <br /> <br />The Board holds the following instream flow water right that may be impacted if these water <br />rights are abandoned: <br /> <br />Case No. <br />5-85CW257 <br /> <br />Stream/Lake <br />Cathedral Creek <br /> <br />Appropriation Date <br />5/3/1985 <br /> <br />Amount (cfs) <br />1.5 <br /> <br />Stream Flow Protection <br /> <br />Stream flow protection may be adversely impacted, if the Water Court deems that these water rights <br />are abandoned, as the subject water rights, which the CWCB has leased from the BLM, are used to <br />augment the Cathedral Creek instream flow water right. The CWCB wants te support the United <br />States in its attempt to have these water rights removed from the abandonment list. The CWCB <br />intends to file an application in the Water Court to change the use of the subject water right for <br />instream flow purposes within two years. <br /> <br />Other Objectors <br /> <br />There are no other protesters or obj ectors in this case. <br /> <br />L:lSection FolderslSECC\Case Files\10021502CW83_mem.doc <br />
