<br />, <br /> <br />. <br /> <br />Project, as a result of emergency or repair operations <br />to and in the Project by Grantor, the Grantors' <br />designees, or the Corps prior to, during and after <br />maintenance operations or a flood event. <br /> <br />f. The Grantee hereby' releases, indemnifies and holds <br />harmless the Grantor and its designees for claims <br />relating to construction, operation, maintenance, and <br />use of the Public Recreation Facilities, including <br />damages associated with the maintenance and operation <br />of the Project for flood control, drainage, or water <br />flow regulation purposes, unless claims arise in part <br />or in whole out of the negligence of agents, officers, <br />or employees of the Corps, the Grantor or its <br />designees. <br /> <br />. <br /> <br />Throughout the term of this Easement, including but not <br />limited to any renewal term, the Grantee shall maintain <br />continual commercial general liability insurance <br />covering its construction, maintenance and operational <br />activities on the Easement as well as the use of its <br />facilities which are located upon the Easement by <br />members of the general public. Said insurance shall <br />name the Grantor as an additional insured. A copy of <br />the current certificate(s) of insurance shall be <br />attached to this Contract and Easement as Exhibit Hand <br />thereby incorporated herein by reference. Notices <br />of renewal of this insurance shall be provided to the <br />Grantor on an annual basis. Said policy shall provide <br />coverage in the following amounts: <br /> <br />1). For any injury to one person in any single <br />occurrence, the sum of One Hundred Fifty Thousand <br />Dollars ($150,000). <br /> <br />2). For any injury to two or more pe~s6ns in any <br />single occurrence, the sum of One Million Dollars <br />($1,000,000). <br /> <br />3). For any damage to property, the sum of Five <br />Hundred Thousand Dollars ($500,000) for each <br />occurrence. <br /> <br />g. The Grantee understands and agrees that the <br />Grantor makes no representations concerning ownership <br />of nor warrants title to any of the property underlying <br />the Easement. To the extent that this grant of Ease- <br />ment may encroach on lands not owned or controlled by <br /> <br />. <br /> <br />9 <br />
