The Grantor reserves the right to <br />grant additional easements to third parties, provided <br />that said easements do not materially interfere with <br />the Easement granted herein~ Grantee expressly agrees <br />to subordinate this Easement to all prior easements <br />within the Project granEed by the Grantor. The Grantee <br />agrees to share this Easement, provided that the <br />additional easements do not materially interfere with <br />the purposes for which the instant grant is made. <br />Grantee shall be 'entitled to such damages as may result <br />from any impairment of Grantee's use of the land caused <br />by the additional easements. <br /> <br />c. If the Grantee does not for a period of 366 con- <br />secutive days make use of this Easement for the purpos- <br />es specified in paragraph 3, then Grantor may, in its <br />sole discretion, immediately declare the Easement <br />abandoned and terminated and shall notify Grantee of <br />same by certified Mail, Return Receipt Requested. <br /> <br />d. All of the provisions of this Easement shall be <br />binding upon all the parties hereto, their agents, <br />contractors, successors, and assigns and shall run with <br />the land. <br /> <br />The Grantee expressly covenants and agrees: <br /> <br />a. In the event of termination of this Easement, in <br />the event the Grantee elects not to renew this ease- <br />ment, or no longer needs or desires this easement, or <br />in the event that the Grantee constructs or has con- <br />structed any facility(ies), including but not limited <br />to boat chutes, planting of trees, placement of any <br />rocks, not specifically identified in Exhibit D to <br />Exhibit B and/or constructs or has constructed any such <br />facility(ies) outside of the boundaries of this Ease- <br />ment, the Grantor, at its sole discretion, may require <br />the removal, at Grantee's sole expense, of all such <br />facilities from the property and may require the <br />Grantee to restore the property, as nearly as possible, <br />to the condition of the property existing immediately <br />prior to Grantee's first use, all to the Grantor's sole <br />satisfaction. Grantor shall determine to its sole <br />satisfaction whether the proposed or completed restora- <br />tion is in compliance with this paragraph. Should <br />Grantor elect to require that the facilities remain in <br />place, those facilities shall be deeded to Grantor at <br />no cost to Grantor. <br /> <br />7 <br />
