<br />. <br /> <br />. <br /> <br />. <br /> <br />Form 6-AC-02A <br /> <br />:DEPARTMENT OR AGENCY NUMBER <br /> <br />: <br /> <br />: <br /> <br />:CONTRACT ROUTING NUMBER <br /> <br />: <br /> <br />: <br /> <br />CONTRACT FOR AND CONVEYANCE OF EASEMENT <br /> <br />THIS CONTRACT, made and entered into at Denver, Colorado, <br />this day of , 1995, by and between the State of <br />Colorado, acting by and through the Department of Natural Re- <br />sources, for the use and benefit of the Colorado Water Conserva- <br />tion Board, 1313 Sherman street, Denver Colorado, 80202, herein- <br />after referred to as "Grantor", and the South Suburban Park and <br />Recreation District, 6315 South University Boulevard, Littleton, <br />CO 80121, hereinafter referred to as "Grantee" or "Contractor". <br /> <br />WHEREAS, the Grantor is an agency of the State of Colorado <br />created and controlled by Title 37, Article 60, C.R.S. (1989), <br />which functions for the welfare and benefit of the State of <br />Colorado and its inhabitants; and, <br /> <br />WHEREAS, the Grantee is a Metropolitan Park and Recreation <br />District created and controlled by Title 32, Article 1, C.R.S. <br />(1989), whose purpose is to serve a pUblic use and promote the <br />health, safety, prosperity, security and general welfare of the <br />inhabitants within its jurisdictional boundaries; and, <br /> <br />WHEREAS, the Grantor is authorized to enter into this <br />agreement pursuant to the aforementioned statute; and, <br /> <br />WHEREAS, the Grantee is authorized to enter into this <br />Agreement pursuant to the aforementioned statute and its Rules <br />and Regulations, provided that a Resolution is duly passed by its <br />Board of Directors; and, <br /> <br />WHEREAS, the united States Army Corps of Engineers, herein- <br />after referred to as the "Corps", has constructed improvements to <br />the flow of water in the channel of the South Platte River, <br />hereinafter referred to as the "River", in ArapahOe County, State <br />of Colorado. Said improvements are known as the South Platte <br />River Channelization Project, hereinafter referred to as the <br />"project" and were authorized by the Flood Control Act approved <br />
