Resolved Instream Flow Cases:. Section 9.41 of the CWCB's Instream Flow Rules
allow staff to authorize the Attorney General to sign settlement agreements in cases without
Board ratification. However, the settlement must include terms and conditions preventing injury
or interference with an instream flow and cannot involve a modification, or acceptance of injury
or interference with mitigation of an instream flow. We have resolved the issues of potential
injury in the following water court cases and has authorized the Attorney General's Office to
enter into stipulations that provide full protection for the Board's water rights. A summary of the
settlement terms in each of the following cases is attached for your information.
