<br />(2) Case No. 1-02CW84; Glacier Ridge, LLC <br /> <br />The Board ratified the statement of opposition filed in this case at its January 2002 meeting. The <br />Applicant is seeking an amendment to its earlier decreed augmentation plan. The Board has instream flow <br />water rights on Sacramento Creek and on the Middle Fork of the South Platte River that may have been <br />injured by this application. The Board's main objective in filing a statement of opposition in this case was to <br />prevent the Applicant from expanding its augmentation plan to the detriment of the CWCB's water rights on <br />Sacramento Creek and the Middle Fork of the South Platte River. The Applicant through this decree, and through an order that will be attached to the earlier <br />augmentation plan decree, has agreed to reduce the amount of augmentation water available <br />under the earlier augmentation plan. <br /> <br />(3) Case No. 5-00CW306; Bellyache Ridge Metropolitan District <br /> <br />The Board ratified the statement of opposition filed in this case at its March 200 I meeting. The <br />Board's main objective in filing a statement of opposition in this case was to assure that the Applicant <br />replaced its depletions in the same time, place, and amopnt at which they occur. The Staff, in cooperation <br />with the Attorney General's Office, has negotiated a ~ettlement that fully protects the Board's instream <br />flow water rights.
