<br />'I' <br /> <br />r <br /> <br />RULES CONCERNING THE COLORADO INSTREAM FLOW AND NATURAL LAKE <br />LEVEL PROGRAM <br /> <br />1. TITLE. Rules Concerning the Colorado Instr~ Flow and Natural Lake Level Program, <br />hereafter referred to as the Instream Flow ("ISF") Program as established in 937-92-102 (3) <br />C.R$" shall be hereinafter referred to as the "ISF Rules," <br /> <br />2. PURPOSE OF RULES. The pwpose of the ISF Rule's is to set forth the procedures to be <br />followed by the Board and Staff when implementing and administering the ISF Program. <br />By this reference, the Board incorporates the' Basis and Pwpose statement prepared and <br />adopted at the time ofrulemaking. A copy of this document is on file at the Board office. <br /> <br />3. STATUTORY AUTHORITY, The statutoryiauthority for the ISF Rules is found at 937- <br />60-108, C.R.S, and 937-92-102 (3), C,R.S. Nothing in these rules shall be construed as <br />authorizing the Board to deprive the people of the state of Colorado of the beneficial use of <br />those waters available by law and interstate compact. ' <br /> <br />4. DEFINITIONS <br /> <br />4a. Agenda Mailing List. The agenda mailing list consists of all persons who have sent a <br />notice to the Board Office that they wisp to be included on such list. These persons <br />will be mailed a Board meeting agenda prior to each scheduled Board meeting. <br /> <br />4b. Board. Means the Colorado Water Conservaticn Board as defined in 9937-60-101, <br />103 and 104, C.R.S. <br /> <br />4c. Board Office. The Colorado Water Conservation Board's office is located at 1313 <br />Sherman Street, 7th Floor, Denver, CO 80203. The phone number is (303) 866- <br />3441. The facsimile number is (~03) 866-4474, The Board's website is <br />htto://www.cwcb.state.co.us. ' <br /> <br />4d. Contested Hearing Mailing List. The Contested Hearing Mailing List shall consist of <br />all persons who have received Party stiltus or Contested Hearing Participant status <br />pursuant to Rules 51. or Sm. This mailing list is specific to a contested appropriation. <br /> <br />4e. Contested Hearing Particioant. Any persbn who desires to participate in the contested <br />ISF process, but not as a Party, may obtain Contested Hearing Participant status <br />pursuant to Rule 5m. A person with s~ch status will receive all Party documents. <br />Contested Hearing Participants may comment on their own behalf, but may not <br />submit for the record technical evidence; teclmiclu wituesses or legal memoranda. <br /> <br />4f. CWCB Hearing Officer. The Hearing Officer is appointed by the Board and is <br />responsible for managing and coordin~ting proceedings related to contested ISF <br />appropriations, acquisitions or modifications, such as setting prehearing conferences <br />and adjusting deadlines and schedules t9 further the Parties' settlement efforts or for <br />
