<br />. <br /> <br />(2) These rules are intended to assure that infonnation is received by the Board in <br />a timely manner, Where these 'rules do not address a procedure or issue, the <br />Board shall detennine the procedures to be followed on a case-by-case basis. <br />The Board may waive the requirements of these rules whenever the Board <br />detennines that strict adherence to the rules is not in the best interests of <br />fairness, unless such waiver would violate applicable statutes, For any such <br />waiver, the Board shall provide appropriate justification, in writing, to <br />persons who have Party or Contested Hearing Participant status. <br /> <br />(3) In a hearing on a contested ISF appropriation, a Party may raise only those <br />issues relevant to the statutory detenninations required by ~37-92-l02(3)(c), <br />C,RS. and the required findings in Rule 5i. <br /> <br />5k. Notice to Contest. <br /> <br />. <br /> <br />(1) To contest an ISF appropriation, a person must comply with the provisions of <br />this section. The Board must receive a Notice to Contest the ISF <br />appropriation by March 31 st, or the first business day thereafter, ' <br /> <br />(2) A Notice to Contest an ISF appropriation shall be made in writing and <br />contain the following iilfonnation: <br /> <br />(a) Identification of the person(s) requesting the hearing; <br /> <br />(b) <br /> <br />Identification of the ISF approprialtion(s) at issue; and, <br /> <br />(c) The contested facts and a general description of the data upon which <br />the person will rely to the extent known at that time, <br /> <br />(3) <br /> <br />After a Party has filed a Notice to Contest an ISF appropriation, any other <br />person may participate as a Party or a Contested Hearing Participant pursuant <br />to Rules 51. or 5m, <br /> <br />(4) <br /> <br />Staff will notify all persons on the relevant ISFSubscription Mailing List(s) <br />of contested ISF appropriations by April 10th, or the first business day <br />thereafter, <br /> <br />51. Party Status. <br /> <br />. <br /> <br />, <br />i <br /> <br />(1) <br /> <br />Party status will be granted to any person who timely files a Notice of Party <br />Status with the Staff. Any person filing a Notice to Contest shall be granted <br />Party status and need not also file a Notice of Party Status, A Notice of Party <br />status must be received by April 3001, or the, first business day thereafter, A <br />Notice of Party status shall set forth a brief and plain statement of the reasons <br />for obtaining Party status, the contested facts, the matters that the person <br />claims should be decided and a general description of the data to be presented <br /> <br />8 <br />
