Please notify the rest of your staff and the CWCB board that at this <br />time I desire to contest your filing an instream water right on the North Fork of Escalante Creek. This <br />morning I took the time to review again the 91 pages of documentation that the BLM submitted to back up <br />their justification for the water right filing. None of their stream flow measurements were taken on the <br />portion of the stream that is above the Termination point of your adjusted filing. That is the headgate of the <br />Sawtell Ditch. I further determined, that in my opinion, that nobody has ever been to or seen the segment <br />of the stream that you are filing on. I have not been there myself recently. The flow graphs that were on <br />page 61 showing flow verses time are fictitious in relation to what really happens on the stream.
