<br />1. Repayment of the Board's investment shall be guaranteed with the District's ad valoran taxes am revenues fran the
<br />sale of project water, contracts for such sales to be executed to the Board's satisfaction prior to the initiation of
<br />construction on the project.

<br />2. ~ lands am water rights to be purchased by the District for the p:oject shall be app:aised by anindependmt
<br />appraiser or appraisers of the Boam's choice am the aroounts to be paid by the District for such lams am water
<br />rights shall be subject to the Boam's prior app:oval.

<br />Board deans appropriate.

<br />4. Prior to carunencirq construction on the project, the District shall olXain fran the owner(s) of aTr:l lams oojacent
<br />to the reservoir {X)01 (at the maximum water surface elevation) the right to receive any app:eciation in the value of
<br />the lams \'hich is attributable to the construction am existence of the reseJ:Voir if am \'hen tmse lams or aTr:l
<br />p:>rtion thereof are sold by the omer(s). In turn, the District shall contract with the Boam to convey to the Board
<br />any IIPnies \'hich it might receive as a result of this requirenent, said IIPnies to be in addition to the payments
<br />required by item 1 above.
