<br />(2) Any lands and water rights to be purchased by the <br />District for the project shall be appraised by an <br />independent appraiser or appraisers of the Boa.rd' s <br />choice and the amounts to be paid for such lands and <br />water rights shall be subject to the Board's prior <br />approval; <br /> <br />(3) The District shall, prior to commencing construction of <br /> <br /> <br />the project, obtain such public access to the reservoir <br /> <br /> <br />as the Board deems appropriate; and <br /> <br />(4) Prior to commencing construction on the project, the <br />District shall obtain from the owner(s) of any lands <br />adjacent to the reservoir pool (at the maximum water <br />surface elevation) the right to receive any appreciation <br />in the value of the lands which is attributable to the <br />construction and existence of the reservoir if and when <br />those lands or any portion thereof are sold by the <br />owner(s).
