<br />, <br /> <br />.' <br /> <br />11.3 Repair and Breaching of Non-jurisdictional Dams - Repair and breaching of existing non- <br />jurisdictional size dams shall meet the following requirements: <br /> <br />11.3.1 Owners who intend to repair, modify, breach or entirely remove a non-jurisdictional <br />dam shall submit written notice to the State Engineer prior to construction. <br /> <br />11.3.2 High Hazard or Significant Hazard non-jurisdictional size dams shall have the plans <br />for repair or breaching prepared by an engineer and submitted to the State Engineer for <br />approval before construction. The plans shall be of sufficient detail to allow review and <br />provide for the quality control ofthe work and must meet the requirements of Rule 7.1.2. <br /> <br />11.4 Spillway Requirements - Spillway sizing requirements shall meet the criteria for the <br />appropriate hazard classification of the dam for a Minor size dam as specified in the Inflow Design <br />Flood Requirements table in Rule 5.5.6. <br /> <br />11.5 Construction of Jurisdictional Size Dams under Rule 11- The construction of non- <br />jurisdictional size dams under these provisions with freeboard in excess of five feet with the intent <br />to convert the dam to a jurisdictional size structure with only minor modifications to the spillway <br />will not be approved. The modification of a non-jurisdictional size dam to a jurisdictional size dam <br />will not be permitted within 10 years of the construction of the original structure and/or without <br />meeting the requirements of Rule 5. <br /> <br />Rule 12. General Maintenance, Ordinary Repairs. And Emerl!encv Actions: <br /> <br />12.1 General Maintenance - General maintenance and ordinary repairs that do not require prior <br />approval of the State Engineer for the purpose of this Rule shall be those activities that do not <br />impair the safety of the dam. These maintenance and repair activities include: <br /> <br />12.1.1 Removal of brush or tall weeds. <br /> <br />12.1.2 Cutting oftrees and removal of slash from the embankment or spillway. Removal of <br />small stumps is acceptable provided no excavation of more than 3 feet into the embankment <br />occurs. An engineer must oversee removal of trees and stumps larger than 12" diameter. <br /> <br />12.1.3 Rodent control, removal or extermination. Repair of minor rodent damage is <br />acceptable provided it does not involve excavation of more than 3 feet into the <br />embankment. <br /> <br />12.1.4 Repair of erosion gullies on the embankment or in the spillway. Large gullies that <br />have already weakened the dam must be repaired in accordance with Rule 6. <br /> <br />12.1.5 Surface grading of the embankment crest or spillway to eliminate potholes and <br />provide proper drainage provided that the freeboard is not reduced. Material placed on the <br />dam crest to restore the design freeboard must be compacted to specifications outlined in <br />Rule 5.
