<br />Office ofthe State Engineer <br />Rules and Regulations <br />for <br />Dam Safety and Dam Construction <br /> <br />Rule 1. Title: <br /> <br />The title of these Rules and Regulations is "The Rules and Regulations for Dam Safety and Dam <br />Construction." They may be referred to herein collectively as the "Dam Safety Rules" or "Rules" <br />and individually as a "Rule." <br /> <br />Rule 2. Authoritv: <br /> <br />These Rules are promulgated pursuant to the authority granted the State Engineer in sections 37-87- <br />102 and 37-87-105, C.RS. and section 37-80-102(lk), C.RS., and section 24-4-103, C.R.S. <br /> <br />Rule 3. Scope and Purpose: <br /> <br />3.1 These Rules apply to any dam constructed or used to store water in Colorado. These Rules <br />apply to applications for review and approval of plans for the construction, alteration, modification, <br />repair, enlargement, and removal of dams and reservoirs, quality assurance of construction, <br />acceptance of construction, nonjurisdictional dams, safety inspections, owner responsibilities, <br />emergency action plans, fees, and restriction of recreational facilities within reservoirs. Certain <br />struetures defined in Rule 17 are exempt from these Rules. <br /> <br />3.2 The purpose of these Rules is to provide for the public safety through the Colorado Safety of <br />Dams Program by establishing reasonable standards and to create a public record for reviewing the <br />perfonnance of a dam. <br /> <br />Rule 4. Definitions: <br /> <br />4.1 Statutory Definitions - The tenns are defined in section 37-87-102, C.R.S., 37-87-122 C.RS. <br />and 35-49-103 C.RS. and shall have the identical meanings when used in these Rules. <br /> <br />4.2 Specific Definitions - Unless expressly stated otherwise, the following tenns when used in <br />these Rules shall have the meaning indicated by this Rule. Words in the singular shall include the <br />plural. Words in the masculine gender include the feminine and neuter. <br /> <br />4.2.1 "Alteration, Modification, or Repair of an Existing Dam and Appurtenant <br />Structures" means to make different from the originally approved construction plans and <br />specifications or the existing configuration, except for ordinary repairs and general <br />maintenance as defined in Rule 12. <br /> <br />4 <br />
