<br />) <br /> <br />Consent Agenda Item 1a <br />Case No. 5-99CW090; Vail Associates, Inc. <br /> <br />Application Summary <br /> <br />This is an application for a Change of Water Rights and a Plan for Augmentation on Beaver <br />Creek near the town of Vail in Eagle County (see attached map). Applicant proposes the Beaver <br />Creek Diversion as an alternate point of diversion for the Beaver Creek Snowmaking Reservoir <br />No. l. The Beaver Creek Snowmaking Reservoir No. 1 is currently filled using diversions from <br />the Eagle River. The reservoir is decreed in case no. 5-94CW303, which contains terms and <br />conditions protecting the Board's instream flow water rights on the Eagle River, Applicant <br />proposes to augment out-of-priority diversions associated with the Beaver Creek Diversion with <br />releases from Black Lake, Black Lake No.2 and enlargement and return flows from the Beaver <br />Creek and Arrowhead Ski Areas. <br /> <br />CWCB Appropriations <br /> <br />Tlle'Boarcrll01(\s- an InstreariiTow right oI1Beaver CreelCfiif1Z:O-Cfs-cfuiiI1iftlie"'S'ummer (51l~9130) <br />and 4.0 cfs during the Winter (1011-4/30) with an appropriation date of May 1, 1975, which may be <br />injured by this application, <br /> <br />Potential for Iniurv <br /> <br />The Applicant's upstream alternate point of diversion of the Beaver Creek Snowmaking Reservoir <br />No.1 may not replace depletions to the Board's instream flow water rights on Beaver Creek.
