<br />~ <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 State Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />RES 0 L UTI 0 N <br /> <br />A RESOLUTION AUTHORIZING ACQUISITION OF LANDS ALONG THE SOUTH <br />PLATTE RIVER BELOW THE CHATFIELD DAM. <br /> <br />WHEREAS, the Congress of the United States has authorized by <br />Pub. L. 516, 81st Congress (Flood Control Act of 1950) the <br />construction of flood protection along the South Platte River <br />between Chatfield Dam and Denver, Colorado, as one of the <br />projects for flood control in the South Platte River Basin; and <br /> <br />WHEREAS, the district engineer, U.S. Army Corps of Engineers <br />District, Omaha, Nebraska, has formulated a plan of improvement, <br />which has been explained and discussed with local interests, that <br />consists of levees and channel alterations along the South Platte <br />River between Chatfield Dam and Denver, Colorado; and <br /> <br />WHEREAS, the Colorado Water Conservation Board recognizes <br />that the plan will create substantial benefits through the <br />alleviation of flooding and flood damages; and <br /> <br />WHEREAS, pursuant to existing Federal law the State of <br />Colorado must procure the necessary lands, easements, and rights <br />of way for the construction of the channel improvement between <br />the Chatfield Dam and the City of Denver; and <br /> <br />WHEREAS, pursuant to section 37-60-106( 1) (j), C.R.S. 1973, <br />as amended, the Colorado Water Conservation Board is authorized <br />to acquire by grant, purchase, bequest, devise, or lease, any <br />real property or interest therein for the purpose of the <br />prevention or control of floods, or to acquire by eminent domain <br />any real propety or interest therein with respect to any project <br />specifically authorized by the United States Congress for the <br />prevention or control of floods, including but not limited to <br />easements and rights of way for ingress into and egress from such <br />proiect; an1 <br /> <br />WHEREAS, the Colorado Water Conservation will have <br />appraisals done for the land to be acquired for the channel <br />improvements; and <br /> <br />WHEREAS, section 4 of Chapter 344, Session Laws of Colorado <br />1979, authorizes the Colorado Water Conservation Board to oroceed <br />with the Chatfield Project channel improvement provided that a <br />contract with the United States is reached whereby the United <br />States agrees to provide not less than one-half of the total cost <br />of the said channel improvement; and <br /> <br />177 <br />res <br />
