<br />FPR 197 <br /> <br />COLORAOO WATER CONSERVATION BOARD <br />823 Statg Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />August 16, 1982 <br /> <br />RES 0 L UTI 0 N <br /> <br />WHEREAS, a floodplain information report entitled "Flood <br />Plain Analysis, Eagle River Estates, Town of Gypsum, Eagle <br />County, Coloralio," dated September, 1981, has been prepared by <br />the 81dorado Engineering Company, at the request of the Town of <br />GY?SllIn; and <br /> <br />:'/HEREAS, said report describ'ls and outlings the floodplain <br />d'lta and information for thg sto~ and floodwater runoff channels <br />or basins for that porti<)r'l of t'1e E'Igle River within the current <br />':orporate limits of t'1e Town of Gypsu"!\ belo',o/ the U.S. '1igl-1't13.y 6 <br />bridge only: and <br /> <br />WHEREAS, the Town of Gypsum has requeste'l the Colorado Water <br />COr'lservation Boar'! to de"ignate and approve the floo-:lplain 'Ireas <br />as set forth in the aforesaiCl reoort: and <br /> <br />;'iHEREAS, <br />1973, requires <br />t~ie preve nt ion <br /> <br />Section 37-50-106(1), Colorado Revised Statutes <br />the Colorado Water Conservation Board to assist in <br />of floods and flood damages therefrom: and <br /> <br />WHEREAS, Sections 31-23-301 an:'! 30-28-111, Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local <br />iurisliictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to designate <br />and approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies of local <br />jurisdictions: and <br /> <br />WHEREAS, the staff of the Board has reviewed sai:'! report and <br />does hereby recommend to the Colorado Water Conservation Board <br />that the Board designate and approve as floodplain areas those <br />areas inundated by a 100-year flood (intermediate regional flood) <br />as described by the floodwater Surface elevations and profiles in <br />said report: <br />
