<br />680 <br /> <br />Section 147-18-12. Jurisdiction of the Water <br />board or State Engineer shall not be impaired by reason <br />of failure of either to act within any period of time <br />specified herein. <br /> <br />Section 147-18-13. The Colorado Water Conser- <br />vation Board shall have the power, and it shall be its <br />duty, to investigate and determine the nature and extent <br />of the underground water resources of the state of Colorado. <br />It shall also be the duty of said Water board to study and <br />determine the effect, if any, of the withdrawal of ground <br />water upon aquifer supply and upon the surface flow of <br />streams, and the information obtained thereby shall be made <br />available to the State Engineer and, for such reasonable <br />fees as may be established, to any interested person. <br />Nothing herein shall be construed as impairing the author- <br />ity of the State Engineer to make such investigations as <br />he may find necessary or desirable to enable him to per- <br />form his duties hereunder. <br /> <br />I <br /> <br />Section 147-18-14. Any person aggrieved by an <br />order or act of the Water board or the State Engineer may, <br />wi thin sixty days after notice thereof, initiate a proceed- <br />ing in the district court having jurisdiction of the area <br />in which the ground water use is located for a review of <br />the action or finding of which he complains. The hearing <br />in the district court shall be a trial de novo and shall <br />be an exclusive remedy. The pleadings, practice and pro- <br />cedure in such suits shall conform with the Colorado Rules <br />of Civil Procedure. <br /> <br />Section 147-18-15. All monies collected as fil- <br />ing fees in compliance with sections 147-18-4 and 147-18-7 <br />herein, and all monies collected as license fees in compli- <br />ance with section 147-18-11 herein, shall be paid to the <br />Department of Revenue and deposited in the general fund of <br />the State of Colorado. <br /> <br />Section 147-18-16. Any violation of this Arti- <br />cle shall be a misdemeanor and shall be punishable by a <br />fine of not more than Three Hundred Dollars ($300), or by <br />confinement in jail for a period not exceeding six months, <br />or by both such fine and imprisonment, provided, however, <br />that the provisions of this section shall not be deemed <br />to prohibit an action by any aggrieved person or party to <br />enjoin any act prohibited by this Article. <br /> <br />Section 147-18-17.
