BARNARD:

and because of a group in the center
of an area saying they didn't want
it, we couldn't properly do our duty.

Does anybody want to second Mr.
Miller's amendment? I don't hear any
second so the motion is killed."

I

"~ay I make one more observation.
We talk about critical areas but we
ought to keep in mind there are only
two or three critical areas we can be
concerned with at this time. Here
it is set out that the Board shall
have the power to determine a critical
area and I take it this act means
exactly what it says. There are a
limited number of those critical areas
in the State that would qualify under
this act, and they are relatively
small. "

"Another point is that if there
is just one area in the State of
Colorado that needs designation as
'critical', that is justification
enough for the passage of this bill."

"I would like to ask Mr. Barnard
what the regulation of tentatively
critical areas provides - would such
regulations be initiated by the Water
Board without any other group partici-
pating?"

"Proceedings to determine .the
existence of a critical area could
either come by local people or by
study as iridicated in the bill."

"If this Board has the right in
itself to designate tentatively criti-
cal areas, what provision, if any, in
this present bill, do the local peo-
ple have to ask for a hearing?"

I

"Section 5, the first sentence
answers your question, I believe."
