Subject to the "General Criteria for Ruedi Releases" presented by the Service at the public <br />meeting held in May 2000, in Basalt, Colorado, and existing obligations of Reclamation for <br />releases from Ruedi Reservoir, Reclamation will make a reasonable effort to operate Ruedi <br />Reservoir to have a minimum storage of95,000 acre-feet on September 1, 2000, and 85,000 <br />acre-feet on October 1, 2000, and to limit the maximum release to 250 cfs. Provided, however, <br />the operation ofRuedi Reservoir to meet these storage amounts and limiting the maximum <br />release pursuant to this MOA shall not be precedent nor bind Reclamation to this operation of <br />Ruedi Reservoir beyond the scope and term ofthis MOA. <br /> <br />8. ENVIRONMENTAL COMPLIANCE <br /> <br />e <br /> <br />The Environmental Compliance for performance under this MOA is pursuant to EIS-88- I 0, <br /> <br /> <br />FSES-89-19, and Categorical Exclusion Checklist No. ECAO- 00-3 L <br /> <br />9. ENFORCEMENT <br /> <br />a. The Board will take such action under state law, including requesting administration by the <br />State Engineer's Office and initiating water court proceedings, as may be necessary to obtain <br />delivery of the water from the outlet works ofthe dam from which the water is released to the <br />beginning of the IS-mile reach and to protect the release from diversion by third parties within <br />the IS-mile reach, subject to such transit losses as may be imposed by the State Engineer or the <br />Division Engineer for Water Division 5. Reclamation will cooperate with the Board to protect <br />the water released from the outlet works of the dam from which the water is being released <br />e through, and to the downstream terminus of, the IS-mile reach. <br /> <br />11 <br />
