Flood Protection Section - Special Contract Provisions for Montezuma County <br />Tape 3, Track 1 1:20:00 -1:26:00 <br />Action: A motion was made by Don Schwindt with a second by Carolyn McIntosh to <br />approve the staff recommendation to add the following provisions to the <br />contract between the CWCB and Montezuma County prior to proceeding with <br />this project: <br />1) Future development in the Dolores River Valley near the floodplain <br />will require a floodplain review, following the minimum NFIP <br />standards, and will require the issuance of a floodplain development <br />permit. <br />2) For the interim period, until the new floodplain study is prepared, <br />Montezuma County will use the existing Flood Insurance Study and <br />the US ACE study for floodplain development, floodplain review, and <br />the issuance of floodplain development permits. <br />3) Montezuma County will cost share in the floodplain mapping <br />component of this study with $20,000 in cash and in-kind services and <br />the CWCB will commit $50,000 to this project. <br />4) Montezuma County will meet the minimum NFIP requirements and <br />will maintain eligibility in the NFIP. <br />5) Montezuma County shall use mapping specifications for this project <br />under guidance from the CWCB, FEMA and US ACE.. <br /> <br />The motion was approved 9-0. With respect to Part C, the staff ranking <br />was approved and funding shall be allocated funding based on the amount of <br />Severance Tax available within the CWCB' s five-percent share. It would not <br />be known how much funding would be available until the Executive Branch <br />and the General Assembly act on proposals to divert a portion of Severance <br />Tax to the General Fund, place a cap on contribution into the Operational <br />Account, or keep agency funding static for other budgetary reasons.
