19. Flood Protection Section - Special Contract Provisions for Montezuma County

Action: A motion was made by Don Schwindt with a second by Carolyn McIntosh to
approve the staff recommendation to add the following provisions to the
contract between the CWCB and Montezuma County prior to proceeding with
this project:
1) Future development in the Dolores River Valley near the floodplain
will require a floodplain review, following the minimum NFIP
standards, and will require the issuance of a floodplain development
permit.
2) For the interim period, until the new floodplain study is prepared,
Montezuma County will use the existing Flood Insurance Study and
the US ACE study for floodplain development, floodplain review, and
the issuance of floodplain development permits.
3) Montezuma County will cost share in the floodplain mapping
component of this study with $20,000 in cash and in-kind services and
the CWCB will commit $50,000 to this project.
4) Montezuma County will meet the minimum NFIP requirements and
will maintain eligibility in the NFIP.
5) Montezuma County shall use mapping specifications for this project
under guidance from the CWCB, FEMA and US ACE..

The motion was approved 9-0. Greg Walcher was not present.

22. FY 04-05 Severance Tax Recommendations

Action: A motion was made by Carolyn McIntosh with a second by Don Schwindt to
approve the staff recommendation. With respect to Part C, the staff ranking
was approved and funding shall be allocated funding based on the amount of
Severance Tax available within the CWCB' s five-percent share. It would not
be known how much funding would be available until the Executive Branch
and the General Assembly act on proposals to divert a portion of Severance
Tax to the General Fund, place a cap on contribution into the Operational
Account, or keep agency funding static for other budgetary reasons. The
