The majority of White Water park construction <br />consists of the discharging of material into a river or stream, so White Water parks fall <br />under the federal jurisdiction by the way of the Clean Water Act. It may take four to six <br />months to obtain a pennit. <br /> <br />u.s. Fish and Wildlife Service USFWS can also have jurisdiction over a park under the <br />Endangered Species Act if there is any endangered fish species near the proposed site. <br /> <br />Federal Emerllencv Manallement AVencv - FEMA has flood elevations established in the <br />FEMA Flood Insurance Rate maps. Notification to FEMA may be required. <br /> <br />. <br /> <br />In addition, depending on land ownership, endangered plants and animals, soil composition <br />and other issues the following agencies can assume some jurisdiction over river enhancement <br />projects: <br /> <br />Bureau of Reclamation -BOR <br />Bureau of Land Management -BLM <br />Environmental Protection Agency - EPA <br />U.S. Forest Service - USFS <br /> <br />If federal Jl10ney is used on the project, an Environmental Assessment (EA), must be performed. If the <br />site is on or near known Native American sites, the local Tribes will have to sign off on the permit as . <br />well. <br /> <br />State Permits <br /> <br />Depending on the project, there can be several state agencies that have jurisdiction over river <br />enhancement projects, and those that do will receive a copy of the 404. permit application. <br /> <br />Department of Natural Resources - DNR - concerned with impact on aquatic and habitat <br />environment. <br />Division of Wildlife- OOW - concerned with impact on aquatic and habitat environment. <br />Department of Health - water quality permit that is mainly concerned with impacts during <br />construction. <br />Department of Transportation - COOT. involved if the project is on or near their jurisdiction <br />or there are access issues. <br /> <br />. <br /> <br />CODDtv Permits <br /> <br />The county process may involve Flood Plain Manager, Water Conservation Districts, Division of Water <br />Rights and a Water and Sanitation District. The County may have to approve the project if the project is <br />on land outside of city limits. The local health department may also have jurisdiction over projects. <br /> <br />Cltv PermIts <br /> <br />The project and possibly some of the funding may need to be approved by the City Council or Town <br />Board if the project is within city limits.
