In February 2003, the Pine River Irrigation <br />District (PRID) and Southern Ute Indian Tribe requested CWCB staff to consider a "water donation" <br />proposal in lieu of a new instream flow appropl iation to preserve the natural environment of the Pine <br />River. PRID and the Tribe hold decrees for water stored in Vallecito Reservoir, which they would donate <br />to the CWCB for instream flow use, subject to certain terms and conditions. Since 2003, staffhas worked <br />with representatives from PRID and the Tribe to craft an agreement to provide stream flow protection for <br />the Pine River with releases of storage water, while allowing PRID and the Tribe flexibility in their day- <br />to.,day operation ofttu: reservoir. <br /> <br />In September 2005, staff presented an overview of the water donation proposal to the CWCB board . <br />members in Durango. At that meeting, representatives from PRID and the Tribe expressed support for the <br />''water donation" approach, and local interests also presented comments and concerns to the CWCB board <br />members. <br /> <br />Following the CWCB September board meeting, staffmet with representatives from PRID and the Tribe <br />to review and revise the latest draft of the agreement. All parties seemed confident that the agreement <br />was close to final form, and a revised draft has now been circulated to the parties for review and approval <br />by their respective Boards and Councils. If the draft agreement is approved, staffwill initiate the water <br />acquisition process at the January 2006 CWCB meeting in Denver. <br /> <br />Umetco Water Rights Report Update. On Oct. 4 the CWCB held a follow-up meeting with local <br />officials in the Nucla-Naturita area to discuss the findings of the Umetco water rights investigation. The <br />meeting took place at the Nucla Town Hall, and CWCB Board member Don Schwindt participated in the <br />meeting on the Board's behalf. The CWCB's consultant presented a summary of the water rights <br />investigation report which was well received and prompted a fairly long discussion about potential uses of <br />the water rights. The attached memo summarizes the discuasions that took place at the meeting and <br />provides a list of attendees. <br /> <br />AgeDcy Updates <br />De Minimis Report - please see the table in the Attachments. <br /> <br />Stream and Lake Protection Program - Summary of Resolved Cases: The Board's ISF Rule 8i. states <br />that: "In the event the pretrial resolution includes terms and conditions preventing injury or interference <br />and does not involve a modification, or acceptance of injury or interference with mitigation, the Board is <br /> <br />. <br /> <br />28 <br />
