The motion was seconded by Eric Kuhn and <br />approved unanimously (9-0). Following the Executive Session, Harold <br />Miskel made a motion that the Board approve the staff recommendation <br />as amended by Eric Kuhn. Patricia Wells seconded the motion. The <br />motion was approved unanimously (9-0). <br /> <br />6. Stream and Lake Protection - Approval of Fourmile and Oil Creeks Hearing Orders <br />Tape 1 , Start/Stop: 0150 - 0983 <br />Action: Jennifer Gimbel updated the board on the Fourmile Creek and Oil Creek <br />pre-hearing conference and order. A motion was made by Don Schwindt <br />that Jennifer Gimbel will be the hearing officer. The motion was <br />seconded by David Smith and approved unanimously (9- 0). After <br />discussion by the Board, Dan McAuliffe determined that the combined <br />Board meeting/hearing should start at 8:00 a.m. on Monday, September <br />25,2000, Tuesday, September 26,2000 and Wednesday, September 27, <br />2000. <br /> <br />7. Impacts of Initiative 205 on Water Districts <br />Tape 1, Start/Stop: 1775 - 2450 <br />4330 - 4697 <br />Action: Dan McAuliffe presented information about Initiative 205 and offered the <br />opportunity for Board members to express their points of view about the <br />initiative. Eric Kuhn made a motion that the Board adopt a resolution <br />opposing at a special meeting in August. Patricia Wells seconded the <br />motion. The motion was approved unanimously (9-0). Staff will circulate <br />the text of a resolution opposing the initiative. <br /> <br />8. Executive Session Briefing <br />Tape 1, Start/Stop: 4734 - 4946 <br />Action: Carol Angel briefed the Board on the Defenders of Wildlife vs. Babbitt, Federal <br />District Court for the District of Columbia and the National Forest <br />Reserved Rights Cases Divisions 2 and 7. A motion was made and <br />seconded that the Board go into Executive Session. The motion was <br />approved unanimously (9-0). <br /> <br />9.
