PRill and the Tribe will file a joint application for a new junior storage right for Vallecito <br />Reservoir which provides for instream flow use by CWCB in the Pine River. <br /> <br />. CWCB, PRill and the Tribe will use best efforts to provide for the purchase or lease of water <br />from Vallecito to supplement the donated water. <br /> <br />. Storage level < 60K 5 cfs <br />Emergency/Shortage condition release 5 cfs <br /> <br />In order to evaluate whether the proposal provided a level of protection equal to or greater <br />than a standard new instream flow appropriation, staff requested instream flow recommendations <br />from CDOW, Based on previously collected field data, CDOW provided an initial instream flow <br />recommendation to preserve the natural environment of 90 cfs during the summer months and 50 cfs <br />during the winter months. CDOW has recently completed analysis of data collected in 2004 and <br />provided staff with a new recommendation of 136 cfs in the summer and 75 cfs in the winter. Staff <br />will be evaluating the new biological recommendation in light of the water made available through <br />this agreement. <br /> <br />Next Steps <br /> <br />Staff recently met with Doug Lemming, one ofthe original proponents, and the CDOW to <br />review the proposed acquisition agreement. Mr. Lemming has provided the attached email and <br />requested that it be distributed to the CWCB members. There are still some issues to be discussed <br />and resolved with PRID and the Tribe, but generally, staff believes the agreement can meet the <br />stated goals. Once finalized, Staff will present the agreement to the Board for consideration and <br />initiate the formal acquisition process at the November 2005 Board meeting. <br /> <br />Attachments <br /> <br />Flood Protection.
