<br />Department of Natural Resources <br />July 12,2000 <br />Page 2 <br /> <br />From a policy standpoint, this case has the potential to establish precedent which would allow <br />decrees for huge instream flow water rights at controlling locations on maj or water sheds in the <br />state. This could severely limit the ability to appropriate water and could become a valuable tool <br />to both in state and out of state interests that would desire to preclude future appropriations <br />within the state. <br /> <br />Unfortunately, Clear Creek County does not have the financial resources to oppose this <br />application on its own. It is imperative that the State actively opposes this Application to protect <br />the right to appropriate water on Clear Creek.
