<br />I <br /> <br />water districts. The problem comes up when <br />you are administering a whole river. The <br />present procedures for notice don't cover a <br />basin. They cover that water district or <br />may, in certain instances, cover one or two <br />water districts but they don't cover the <br />South Platte or the Arkansas from the head- <br />waters to the state line. <br /> <br />Another thing, a person might not ch~ge <br />the point of diversion but he might go in <br />there and change the place of use or the <br />character of use. Under those provisions <br />we have no statutory proceedings under the <br />present law so that nobody would get notice. <br />As we develop and as we get into this in <br />more detail and as water gets scarcer, this <br />is what causes the problems up and down these <br />streams. So we have stayed with the basin <br />concept and we have made provisions for <br />administration so that the water commission- <br />er's office which hasn't been changed in <br />over 100 years and says nothing about wells <br />whatsoever is going to be set aside as such <br />and those water commissioners will be tied <br />to the division engineer to carry out the <br />basin concept. <br /> <br />I <br /> <br />I see no problems in working this out, <br />Mr. Chairman. I am sure that there has been <br />much thought given by people who received <br />copies of this most recent draft. Senate <br />Bill 81, the Water Right Determination Act <br />of 1969, which has already been introduced, <br />has this proposal so close - not questions <br />of substance, I know Larry and I use sub- <br />stance in these matters in pretty much the <br />same way - it's methods. Some people have <br />one idea as to how to do it and some another <br />but I think we have a concensus on this and <br />I would be hopeful that as long as Mr. Wel- <br />born, who had responsibility for Senate Bill <br />81, and to achieve the unanimity which I am <br />sure we can achieve, that I think you can <br />get into too big of a group at this phase of <br />
