Appendix A: Letter from Regional Forester to CWCB

e

United States
Department of
Agriculture

Forest
Service

Rocky
Mountain
Region

P.O. Box 25127
Lakewood, CO 80225-0127
Delivery: 740 Simms St.
Golden, CO B0401

File Code: 2540

Date: April 25, 1995

Colorado Water Conservation Board
Attention: Mr. Lile
721 State Centennial Building
1313 Sherman Street
Denver, CO 80203

Dear Mr. Lile:

At your invitation, the Forest Service is recommending Colorado Water
Conservation Board acquisition of an instream flow water right on the East Fork
of Dead Horse Creek within the White River National Forest. This stream,
tributary to the Colorado River, is located in Sections 7, 18 and 19, T.SS.,
R.87W., Section 31, T.4S., R.B7W., Section 36, T.4S., R.88W., and Sections 1
and 12, T.5S., R.88W., 6th PM.

e

This stream is the source of water for Bridal Veil Falls above Hanging Lake,
both being very popular recreational and scenic attractions for travelers using
Interstate 70 through Glenwood Canyon. The Forest Service has used funds to
maintain the trail to Bridal Veil Falls and Hanging Lake. The state presently
is constructing a rest stop and trailhead to accommodate the large number of
visitors who use this trail to experience these scenic attractions.

We recommend that an instream flow water right for the total unappropriated
flow of this stream be acquired for recreation, aesthetics, fish, and wildlife
purposes. Anything less would diminish the aesthetic qualities of these
features during parts of the year because of the unique} permeable character of
the geological rock formation containing the stream, Bridal Veil Falls and
Hanging Lake.

Jim Maxwell of my staff is available to discuss our needs and to work with you
on this matter. I look forward to our agencies working together in a
cooperative manner to resolve water resource issues involving Region 2 of the
Forest Service.

Sincerely,

IS/Elizabeth Estill

e

ELIZABETH ESTILL
Regional Forester

17
