The <br />new spillway structure will be very similar to the undisturbed site in terms of agricultural <br />use, wildlife habitat, vegetation, etc. <br /> <br />PERMITTING <br /> <br />. <br /> <br />Possible permit requirements and current status are listed below. <br /> <br />1. Spillway easement lease across Anchutz property. The lease negotiations are <br />complete and there are no foreseeable problems with the lease. <br /> <br />2. Spillway lease/purchase of property across a 40 acre tract of Bureau of Land <br />Management property. As a part of the spillway construction, this tract is expected <br />to be purchased from the BLM along with a sizable tract under and adjacent to the <br />reservoir. This property has been offered for sale to RRLC by the BLM, and <br />negotiations are ongoing. <br /> <br />3. A Weld County 1041 permit is not required for this project. <br /> <br />4. Fugitive Particulate Air Pollution Emission Notice/Control Plan permit with the <br />Colorado Department of Health and Environment will be required. No problems are <br />anticipated with the acquisition of the permit. <br /> <br />5. Stormwater Discharges Associated with Construction Activity permit with the <br />Colorado Department of Health and Environment will be required.
