<br />. <br /> <br />. <br /> <br />. <br /> <br />water from the River District's pool in the reservoir enlargement, The proposal is for <br />Reclamation to convey the easement and water right, and sublease the 2,000 af of water to the <br />CWCB to monitor and protect instream flows to and through the Critical Habitat Reach on the <br />Yampa River. <br /> <br />Over the past several months, CWCB staff has been working with the Department of Natural <br />Resources, the River District and federal agencies acting on behalf of the Recovery Program, to <br />develop the numerous legal documents and the terms and conditions required to implement the <br />proposed conveyance and lease of water for endangered fish, A proposed "map" of the <br />agreements is included for reference, The agreements address each entities responsibilities and <br />obligations with regard to the reservoir enlargement and water right conveyance, <br /> <br />Since January 2004, final drafts of the Contract and Grant of Easement for Storage Space, <br />the Deed, the 20- Year Lease Agreement, and the DNRlUCRIP Cost Share Agreement have <br />been prepared and submitted for review by the federal Solicitor's Office and the State Attorney <br />General. The Acquisition Agreement will be finalized and presented to the CWCB for <br />consideration at the May 2004 Board meeting, pursuant to Rule 6 of the Instream Flow Rules, <br />Final approval by the CWCB is expected at the July 2004 Board meeting. If approved by the <br />Board, the CWCB Stream and Lake Protection Section will coordinate, monitor and protect <br />releases of water from Elkhead Reservoir to and through the Critical Habitat Reach pursuant to <br />the Acquisition Agreement. <br /> <br />Proposed "Map" of Required Agreements <br /> <br />29 <br />
